Ohio allows only judicial real property foreclosures. The foreclosure period is therefore determined by how fast the foreclosure can be processed through the court system. The foreclosure is started by filing a Complaint in court, then serving it upon the Borrower, who then has 28 days to respond to the Complaint. Throughout this period and for a time thereafter, the Borrower may stop the foreclosure by paying the amount due including the foreclosure costs. If the Borrower does not pay, the court issues an Order of Sale, directing the local Sheriff to auction the property. Prior to the Sheriff’s auction, the Sheriff must obtain three appraisals, and publish the sale in a local newspaper. To be successful, a bid at the auction must be at least two thirds of the appraised value. After the sale the court is asked to confirm the sale. The Borrower can redeem the property until confirmation by paying the amount due, plus foreclosure costs.
